Fork truck licence ( refresher)

Hi I'm looking for some advice I started a new job 3 month ago as a counter balance driver, my certificate expired 4 weeks ago, I told my manager that it had ran out and that I didn't realise, he said it's ok everyone's in here Had expired ages ago and that it's part of my job to keep driving. I told him I won't be driving until I get it renewed which he wasn't happy about, he then said that he would sort a refresher out for me and the other who are all due one by a year or so, he then came over and said that I will have to sort my own refresher course out as it's my problem.
This this right is it up to me to sort it or my employer and I can refuse to drive one until I have a refresher done

Paul. Certificates don't actually expire unless you are on the RTITBs NORS database when they expire after 3 years. The requirement to have forklift operators trained falls on the employer in law not the employee, (section 2 c of the HASAW Act). You are free to refuse to do anything at work including driving the truck but I can't say what the employer's reaction would be. It is the employer, not you, who would get prosecuted under these circumstances in the event of an accident.

It is your employers responsibility to sort out refresher training for their employees.
Although it is not a law that you carry out refresher training it is just advisory by the ACOP Manual to carry out training especially if employees have had an accident.
